1. Introduction and Acceptance of Terms
These Terms & Conditions apply to all roofing and associated building works undertaken by FlatRoof Masters, including roof replacements, roof repairs, pitched roofing, flat roofing, slate and tile roofing, leadwork, chimney repairs, guttering and waterproofing.
By accepting a quotation or instructing FlatRoof Masters to undertake work, the customer agrees to these Terms & Conditions, provided they have been supplied before the contract is formed.
All works are subject to applicable consumer protection legislation.
2. Quotations and Estimates
All quotations are valid for 30 calendar days unless otherwise stated.
Quotations cover only the works specifically described and may be revised where the quotation expires or the customer requests changes to the agreed specification.
Any additional works or charges must be discussed and agreed with the customer before proceeding.
Estimates are approximate indications of cost and may differ from the final price where reasonably justified and communicated to the customer.
3. Deposits and Advance Payments
FlatRoof Masters operates the following deposit structure:
- Projects up to £2,000: No standard deposit required.
- Projects above £2,000 up to £5,000: A 5% deposit is required upon acceptance of the quotation.
- Projects above £5,000: A 10% deposit is required upon acceptance of the quotation.
Deposits are used towards the purchasing and ordering of roofing materials, equipment, labour arrangements and preparation for the agreed works.
Where a customer cancels a project, FlatRoof Masters reserves the right to retain all or part of the deposit to cover reasonable, evidenced costs and losses already incurred, including materials purchased or ordered specifically for the project, where legally permitted.
Materials that can reasonably be returned or reused will be taken into account when calculating any cancellation charges.
Deposits are not automatically non-refundable. Any refundable balance will be returned to the customer in accordance with applicable law.
All deposits are deducted from the total agreed contract value.
4. Staged Payments
For projects exceeding £5,000, the following payment structure applies:
- Stage 1 – 10%: Upon acceptance of the quotation.
- Stage 2 – 25%: Once the agreed site preparation milestone is reached, including delivery of principal roofing materials or installation of scaffolding, as specified in the quotation.
- Stage 3 – 55%: Once approximately 90% of the agreed roofing works have been completed.
- Stage 4 – 10%: Upon completion of all agreed works.
All staged payments are calculated against the total agreed contract value.
Payments become due only when the relevant agreed milestone has been achieved.
5. Payment Terms and Outstanding Balances
All invoices are payable within seven calendar days unless otherwise agreed in writing.
Where an agreed payment remains outstanding, FlatRoof Masters reserves the right to suspend further works following reasonable written notice, subject to applicable law.
Customers remain entitled to dispute defective or incomplete works and exercise their statutory rights.
6. Materials and Ownership
FlatRoof Masters may order approximately 5% additional materials, or such further quantities as reasonably necessary, to allow for cutting, wastage, breakages and installation requirements.
All unused materials, including surplus tiles, slates, timber, membranes, fixings and other products not incorporated into the completed works, remain the property of FlatRoof Masters unless otherwise agreed.
FlatRoof Masters reserves the right to remove its unused materials from the property following completion.
Materials incorporated into the property are subject to applicable legal ownership rights.
7. Material Prices and Availability
Material prices are based on supplier costs and availability at the time of quotation.
FlatRoof Masters may revise quotations that have expired or where customers request changes to the original specification.
Agreed fixed-price contracts will not be increased solely due to supplier price changes unless a valid and fair contractual adjustment has been agreed.
8. Hidden Defects and Additional Works
Roofing inspections may not reveal defects concealed beneath existing roof coverings.
Where hidden defects are discovered, including rotten timbers, defective battens, damaged decking, structural deterioration or concealed water damage, the customer will be informed.
Any additional remedial works and associated costs must be agreed before proceeding.
Where the customer declines necessary remedial works, FlatRoof Masters may suspend or decline the affected work if it cannot be completed safely or to an appropriate standard.
9. Roof Structure and Supporting Materials
Unless expressly included within the quotation, the replacement of structural timbers, beams, joists, battens, roof decking, insulation and other concealed supporting components is excluded.
Any additional structural or supporting work required will be assessed and quoted separately.
10. Existing Roofs and Previous Workmanship
Where repairs are undertaken to an existing roof, FlatRoof Masters is responsible for carrying out the agreed repair works with reasonable care and skill.
FlatRoof Masters does not guarantee the condition, remaining lifespan or performance of unrelated roof areas, existing defective materials or previous contractors’ workmanship.
Repairs to individual roof areas do not constitute a full roof replacement or guarantee that other defects will not develop.
11. Weather Conditions and Project Delays
FlatRoof Masters reserves the right to postpone or suspend roofing works where weather conditions make installation unsafe or unsuitable.
Delays may also arise from material shortages, supplier disruption, access restrictions, unforeseen defects or circumstances beyond the reasonable control of the business.
Customers will be informed of significant delays as soon as reasonably practicable.
12. Scaffolding and Property Access
Customers must provide reasonable access to the property and working areas.
Scaffolding, access equipment and associated arrangements will be included or excluded as specified within the quotation.
Any additional access costs arising from unforeseen restrictions must be agreed before they are incurred.
13. Waste Removal and Disposal
Where included within the quotation, FlatRoof Masters will arrange the removal and appropriate disposal of roofing waste generated by the agreed works.
Pre-existing rubbish, unrelated building materials, household waste and hazardous materials are excluded unless expressly agreed.
14. Protection of Property
FlatRoof Masters will take reasonable precautions to protect the customer’s property during roofing works.
Customers should remove vehicles, garden furniture, ornaments and other vulnerable belongings from affected working areas where reasonably requested.
FlatRoof Masters remains responsible for damage caused by its negligence or breach of contract.
15. Variations to Agreed Works
Any alterations, additions or changes to the original quotation must be agreed before the additional works commence.
Variations may result in changes to the agreed price, materials required and estimated completion date.
16. Workmanship Standards
FlatRoof Masters undertakes to carry out all agreed roofing works with reasonable care and skill, using suitable materials and recognised roofing practices.
Any defects resulting from workmanship for which FlatRoof Masters is legally responsible will be addressed in accordance with applicable statutory rights.
17. Workmanship Guarantees and Roof Repairs
FlatRoof Masters provides voluntary workmanship guarantees only where expressly confirmed in writing within the customer’s quotation, invoice or separate guarantee documentation.
No voluntary workmanship guarantee is automatically included with any roofing project.
Qualifying new roofing installations may be offered a workmanship guarantee of up to 20 years, depending on the roofing system, agreed specification and written guarantee conditions.
FlatRoof Masters does not provide voluntary guarantees on any roof repair works, including pitched roof repairs, flat roof repairs, slate and tile replacements, leadwork repairs, chimney repairs, waterproofing repairs and repairs to existing roofing systems.
Roof repairs are carried out on existing structures and materials whose condition, age, strength and remaining lifespan may be outside the control of FlatRoof Masters.
Existing deterioration, rotten battens, defective timbers, structural movement, weather exposure and defects in surrounding materials may affect the performance and lifespan of a repair.
Where a customer declines recommended additional remedial works, FlatRoof Masters cannot guarantee the performance of defective existing materials or components left in place.
Any voluntary guarantee applies only to the specific works identified within the written guarantee and does not automatically extend to unrelated roofing areas or previous workmanship.
The absence of a voluntary workmanship guarantee does not exclude or restrict the customer’s statutory rights regarding defective workmanship.
18. Manufacturer Warranties
Certain roofing materials may be covered by separate manufacturer warranties.
These warranties are subject to the manufacturer’s terms, conditions and product requirements.
Manufacturer warranties are separate from any voluntary workmanship guarantee offered by FlatRoof Masters and do not replace statutory rights.
19. Guarantee Exclusions
Any voluntary workmanship guarantee applies only to the works and conditions expressly identified in the relevant guarantee documentation.
Guarantees do not ordinarily cover damage caused by third-party alterations, accidental impact, unrelated structural movement, deterioration of existing materials, inadequate maintenance or defects outside the agreed works.
Roof repairs do not carry a voluntary guarantee under FlatRoof Masters’ standard terms.
No exclusion applies where FlatRoof Masters is legally responsible for defective workmanship, negligence or breach of contract.
20. Roof Maintenance and Customer Responsibilities
Customers are responsible for reasonable roof maintenance, including keeping gutters, outlets and drainage systems clear of excessive debris and blockages.
Any subsequent alterations to roofing systems should be undertaken using suitable materials and appropriate waterproofing methods.
Failure to maintain unrelated roof components does not automatically remove statutory rights or invalidate an otherwise applicable guarantee.
21. Emergency Roofing Works
Emergency roofing works may involve temporary repairs, waterproofing or protective measures intended to reduce immediate water ingress.
Unless expressly stated otherwise, temporary emergency repairs are not permanent roofing solutions.
Emergency repair works do not carry a voluntary workmanship guarantee under FlatRoof Masters’ standard terms.
Any additional permanent works will be quoted separately.
22. Cancellations and Cooling-Off Rights
Customers entering into qualifying distance or off-premises contracts may have a statutory right to cancel within 14 days of entering into the contract.
Where this right applies, FlatRoof Masters will provide the legally required cancellation information and procedure.
Where a customer expressly requests work to begin during the applicable cancellation period, any payment due following cancellation will be determined in accordance with the legal requirements.
Where no statutory cancellation right applies, or the applicable cancellation period has expired, FlatRoof Masters may recover reasonable and evidenced losses arising from cancellation where legally permitted.
Such losses may include materials specifically purchased or ordered, labour already provided and unavoidable preparation costs, taking account of reasonable steps to minimise losses.
Deposits may be retained in whole or in part only to the extent legally permitted. Any remaining refundable balance will be returned to the customer.
23. Postponements and Rescheduling
Customers wishing to postpone agreed works should provide reasonable notice.
Where postponement results in unavoidable additional costs, any reasonable and legally recoverable charges will be discussed with the customer.
24. Customer-Supplied Materials
FlatRoof Masters may decline to install customer-supplied materials considered defective, unsuitable or incompatible with the proposed roofing system.
FlatRoof Masters remains responsible for its installation workmanship but is not automatically responsible for defects inherent in customer-supplied products.
25. Planning Permission and Building Regulations
Where applicable, roofing works must comply with relevant building regulations, planning requirements and statutory obligations.
Responsibility for obtaining necessary permissions, approvals and inspections will be agreed where required.
26. Insulation, Ventilation and Condensation
Unless expressly included within the quotation, existing insulation, ventilation and condensation problems outside the agreed works are excluded.
FlatRoof Masters remains responsible for complying with applicable requirements relating to its own works.
27. Water Ingress During Roofing Works
FlatRoof Masters will take reasonable precautions to protect exposed roofing areas against foreseeable weather conditions and water ingress during installation.
Any damage caused by negligence or failure to take reasonable precautions will be addressed in accordance with applicable law.
28. Completion and Final Inspection
Works will be considered practically complete once the agreed roofing installation has been substantially finished and is suitable for its intended use.
Any minor outstanding items will be addressed within a reasonable period.
Final payment will become due in accordance with the agreed payment structure and applicable consumer rights.
29. Complaints and Defective Works
Customers should notify FlatRoof Masters of any concerns regarding completed roofing works.
FlatRoof Masters will investigate reported defects and, where legally responsible, arrange an appropriate remedy in accordance with applicable law.
The absence of a voluntary guarantee on repair works does not prevent customers from reporting defective workmanship or exercising statutory rights.
30. Photographs and Project Records
FlatRoof Masters may take photographs and videos before, during and after roofing works for inspections, project records, insurance and quality control.
Any promotional use of identifiable customer information or private property details will comply with applicable data protection requirements.
31. Subcontractors and Specialist Trades
FlatRoof Masters may engage suitably competent subcontractors and specialist tradespeople where reasonably required.
FlatRoof Masters remains responsible for fulfilling its contractual obligations.
32. Insurance and Liability
FlatRoof Masters will maintain insurance appropriate to its operations and legal obligations.
The business remains responsible for loss or damage caused by its negligence or breach of contract.
Nothing within these Terms & Conditions excludes liability that cannot lawfully be excluded.
33. Unforeseen Circumstances
FlatRoof Masters will take reasonable steps to minimise delays caused by circumstances beyond its reasonable control, including severe weather, significant supplier disruption and extraordinary events.
Customers will be informed where such circumstances materially affect the project.
34. Customer Conduct and Site Safety
Customers must not interfere with scaffolding, equipment, temporary coverings or active roofing works.
FlatRoof Masters may suspend works where serious safety concerns, threats or unreasonable interference arise, subject to applicable law.
35. Amendments to Terms & Conditions
FlatRoof Masters may update these Terms & Conditions from time to time.
Amendments will apply to future contracts and will not automatically alter agreements already entered into.
36. Governing Law and Statutory Rights
These Terms & Conditions are governed by the laws of England and Wales.
Nothing within these terms excludes or restricts customers’ statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or other applicable legislation.
Where any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent legally permitted.
